dc.description.abstractxJudicial review is the main institute that aims to assure supralegality and relative rigidity to constitutions. Its origin is related to the emergence of constitutionalism itself, essentially to the written Constitutions, more precisely linked to the judgment of the Marbury v. Madison, in 1803, that judicial control of constitutionality was definitively established. However, this decision of the Supreme Court raised several questions from the academy about its compatibility with the constitutional text, with the intention of the framers and their relationship with the democracy, being, until today, problematized. Since the second half of the twentieth century, the judicial model of constitutionality control has expanded extensively throughout the Western world, being present in most democratic countries. With this expansion, the discussion about the legitimacy and difficulties of assigning to a body the power to review the constitutionality of legislation deriving from democratic deliberative processes was also widespread. In this context, the present dissertation begins with the exposition concerning the origins of judicial review, trying to expose the influences and the role of the constituents during the process of elaboration and ratification of the American Constitution, the option to assign to the Judiciary the role of guardian of the Constitution, as well as the doctrine that opposes this movement. The following is a remission on the separation of powers and the role assumed by the judiciary in the main classical theories. The third chapter deals with the relationship between judicial review and countermajoritarian difficulty, exploring the work of Alexander Bickel and the concept of judicial supremacy as the core of the conflict between constitutional jurisdiction and democratic representation. In this chapter, some criticism is formed to the model of judicial supremacy, a theory that places in the judiciary the power to give the last word on the meaning of the constitution. In the fourth chapter, the work focus on an alternative way to the traditional model of judicial review, analyzing the weak form of constitutionality control and the override clause present in the Constitution of Canada, which reshapes the classical model of judicial review, creating an episodic withdrawal of the effectiveness of judicial decisions by Parliament. The chapter also focus on the exposition of the theory of dialogues as conceived by the doctrine in North America and the institutional design generated by the re-sizing of the role of the judiciary and of democratic instances in determining the meaning of the constitution. Finally, the last chapter deals with the current stage of constitutional jurisdiction in Brazil and the possibility of applying dialogical theories in the Brazilian scenario.pt_BR
